General Provisions.

1.1. This User Agreement (hereinafter referred to as the "Agreement") governs the terms and conditions of the services provided by the website marsopolis.best, hereinafter referred to as the "Organizer", and is addressed to an individual wishing to receive services from the said site (hereinafter referred to as the "Participant".)

1.2. To start receiving services, the participant explicitly, fully, and unconditionally accepts all the terms of this Agreement, and, if you do not agree with any terms of the agreement, the Organizer suggests you refrain from using its services.

1.3. The Organizer and the participant recognize the method and form of concluding this agreement as legally equivalent to the agreement concluded in written form.

1.4. The administration of marsopolis.best reserves the right to make any changes and additions to the User Agreement and on the website, without prior notice to users.

Terms and Definitions.

2.1. Game - a type of activity aimed at satisfying human needs in entertainment, pleasure, stress relief, as well as developing certain skills and abilities in the form of free self-expression of a person, not associated with achieving utilitarian goals and bringing joy in themselves.

2.2. Gaming platform - a software and hardware complex of physical devices and software located on the Internet, designed to organize leisure and recreation.

2.3. Game “marsopolis.best”, an online economic game - a separate and unique name of the gaming platform owned by the organizer and located at addresses on the internet marsopolis.best, where the Organizer provides services to the participant for organizing his entertainment, leisure, and relaxation under the terms and conditions set forth in this agreement.

2.4. Gaming inventory - a conditional gaming unit for participation in the game, called “RUB”, the place of accounting and storage of which is the participant's gaming account in electronic form in the format of the gaming platform's accounting system “marsopolis.best”.

2.5. Gaming account - a virtual account of the game participant, provided by the organizer to each participant on the gaming platform for accounting of gaming inventory (RUB).

Subject of this Agreement

3.1. The subject of this Agreement is the provision of services by the organizer to the participant for organizing leisure and relaxation in the game “marsopolis.best” in accordance with the terms of this Agreement. These services, in particular, include the following: services for the purchase and sale of gaming inventory (RUB), maintaining significant information: movements on the gaming account, ensuring measures for identification and security of participants, developing software integrated into the gaming platform and external applications, informational and other services necessary for organizing the game and servicing the participant in its process on the organizer's platform.

3.2. The game as a whole, as well as any of its elements or any associated external gaming application, are created exclusively for entertainment. The participant acknowledges that all types of activities in the game on the gaming platform are entertainment for him. The participant agrees that depending on the characteristics of his account, the degree of his participation in the game will be available to varying extents.

3.3. The participant agrees that he bears personal responsibility for all actions performed with the gaming inventory (RUB): purchase, sale, input, and output, as well as for gaming actions on the gaming platform: creation, purchase-sale, operations with all gaming elements and other gaming attributes and objects used for the gaming process.

3.4. The participant recognizes that the degree and possibility of participation in entertainments on the Game server are the main qualities of the service provided to him.

Rights and Obligations of the Parties.

4.1 Rights and obligations of the participant.

4.1.1. Only persons who have reached civil capacity under the laws of their country of residence may participate in the game “marsopolis.best”. All consequences of non-compliance with this condition are borne by the participant.

4.1.2. The degree and manner of participation in the game are determined by the participant himself, but cannot contradict this Agreement and the rules of the gaming platform.

4.1.3. The participant is obliged to:

4.1.3.1. truthfully provide information about himself at registration and upon the first request of the Organizer provide reliable data about his identity, allowing him to be identified as the owner of the account in the game;

4.1.3.2. not to use the game to perform any actions that contravene international law and the laws of the country - the residence of the Participant;

4.1.3.3. not to use undocumented features (bugs) and errors in the game software and to immediately inform the Organizer about them, as well as about persons using these errors;

4.1.3.4. not to use external programs of any kind to gain advantages in the game;

4.1.3.5. not to use for advertising his affiliate link, as well as the resource containing it, mailings and other types of messages to persons who have not expressed consent to receive them (spam);

4.1.3.6. not to restrict access of other participants or other persons to the Game, to treat participants of the game, as well as the Organizer, his partners and employees respectfully and correctly, not to create obstacles in their work;

4.1.3.7. not to deceive the Organizer and participants of the game;

4.1.3.8. not to use foul language and insults in any form;

4.1.3.9. not to discredit the actions of other players and the Administration;

4.1.3.10. not to threaten violence and physical retribution to anyone;

4.1.3.11. not to distribute materials promoting intolerance or hatred towards any race, religion, culture, nation, people, language, politics, state, ideology, or public movement;

4.1.3.12. not to advertise pornography, drugs and resources containing such information;

4.1.3.13. not to use actions, terminology or jargon to conceal violation of participant's obligations;

4.1.3.14. to take care of necessary computer and other security measures, to keep login, password of the account and other identification data secret and not to transfer them to another person or participant, not to allow unauthorized access to the mailbox specified in the account profile. All risk of adverse consequences of disclosing these data is borne by the participant, as the participant agrees that the gaming platform's information security system excludes the transfer of login, password, and identification information of the participant's account to third parties;

4.1.3.15. to personally bear responsibility for conducting his financial transactions and operations, the Organizer is not responsible for financial transactions made between players for the transfer of gaming inventory and gaming currency, as well as other game attributes;

4.1.3.16. about his claims and complaints to notify the organizer first in writing through the page “Help”;

4.1.3.17. Regularly acquaint oneself with the game news, as well as with changes in this Agreement and the game rules on the gaming platform. The user is obliged to CAREFULLY READ the User Agreement and the description of the project's functions and services at least once a week (as they may undergo changes and additions), as ignorance of the rules does not absolve the user from responsibility for their violation.

4.2 Rights and Obligations of the Organizer.

4.2.1. The Organizer is obliged to:

4.2.1.1. provide free access to the gaming platform and participation in the game for the participant. The participant independently pays for Internet access and bears other expenses associated with this action;

4.2.1.2. keep track of the gaming inventory (RUB) in the participant's gaming account;

4.2.1.3. regularly improve the hardware-software complex, but does not guarantee that the game software is error-free, and the hardware part will function continuously and without interruptions;

4.2.1.4. adhere to the confidentiality regime regarding the participant's personal data as per clause 6 of this agreement;

4.2.1.5. Be financially responsible for ensuring the equivalent market value of the game equipment (RUB) on the participant’s game account. Market value of the game inventory (RUB) is 1 RUB = 1 ₽. Receiving payments by the user is limited by the availability of funds in his cooperative account. 1 RUB on an cooperative account gives the right to withdraw from the system ₽.

Funds are credited to the cooperative account for:

  • Your deposits (30% of the sum)
  • replenishment with a referral of the 1st level (30% of the sum)
  • replenishment with a referral of the 2nd level (10% of the sum)
  • replenishment with a referral of the 3rd level (5% of the sum)

4.2.1.6. Any person, legally owning gaming inventory (RUB), is paid a monetary amount determined by the exchange value (RUB), minus the costs of conducting this operation.

4.2.2. The Organizer has the right to:

4.2.2.1. provide the participant with additional paid services, the list of which, as well as the order and conditions of use, are determined by this agreement, the rules of the gaming platform, and other announcements of the organizer. The organizer may at any time change the number and scope of offered paid services, their cost, name, type, and effect of use;

4.2.2.2. suspend this agreement and disconnect the participant from the game during the investigation of the participant's suspected violation of this Agreement and the rules of the gaming platform;

4.2.2.3. exclude the participant from the game if it is established that the participant violated this agreement or the rules set on the gaming platform, in accordance with clause 5.10 of this agreement;

4.2.2.4. partially or completely interrupt the provision of services without warning the participant during reconstruction, repair, and preventive works on the platform;

4.2.2.5. The Organizer is not responsible for the improper functioning of the game software. The participant uses the software on an “AS IS” basis. If the organizer determines that a malfunction (error) in the platform's operation occurred during the game, then the results that took place during the incorrect operation of the software may be annulled or adjusted at the discretion of the organizer. The participant agrees not to appeal to the organizer regarding the quality, quantity, order, and terms of the gaming opportunities and services provided to him;

4.2.2.6. unilaterally change the course of the gaming inventory.

Guarantees and Liability.

5.1. The Organizer does not guarantee constant and uninterrupted access to the gaming platform and its services in the event of technical malfunctions and/or unforeseen circumstances, including: inadequate functioning or non-operation of internet providers, information servers, banking and payment systems, as well as illegal actions of third parties. The Organizer will make every effort to prevent failures, but is not responsible for temporary technical failures and interruptions in the Game, regardless of the reasons for such failures.

5.2. The participant fully agrees that the organizer cannot be held responsible for the participant's losses that occurred due to illegal actions of third parties aimed at violating the security system of electronic equipment and databases of the game, or due to interruptions, suspensions, or cessation of work of communication channels and networks used for interaction with the participant, as well as unlawful or unjustified actions of payment systems and third parties.

5.3. The Organizer is not responsible for losses incurred as a result of the participant's use or non-use of information about the Game, game rules, and the Game itself, and is not responsible for losses or other harm incurred by the participant due to his unqualified actions and ignorance of the game rules or his errors in calculations.

5.4. The participant agrees that he uses the gaming platform of his own free will and at his own risk. The organizer gives no guarantee to the participant that he will benefit or gain advantage from participating in the game. The degree of participation in the Game is determined by the participant himself.

5.5. The Organizer is not responsible to the participant for the actions of other participants.

5.6. In case of disputes and disagreements on the gaming platform, the decision of the organizer is final, and the participant fully agrees with it. All disputes and disagreements arising from this Agreement or in connection with it shall be resolved through negotiations. In case it is impossible to reach an agreement through negotiations, disputes, disagreements, and claims arising from this Agreement shall be resolved in accordance with the applicable legislation.

5.7. The Organizer does not bear the tax burden for the Participant. The participant undertakes to independently include any possible income received in the tax declaration in accordance with the legislation of his country of residence.

5.8. The Organizer may unilaterally make changes to this Agreement, the rules of the gaming platform, and other documents. In case of changes to the documents, the Organizer posts the latest versions of the documents on the gaming platform's website. All changes take effect from the moment of posting. The participant has the right to terminate this Agreement within 3 days if he does not agree with the changes made. In this case, the termination of the Agreement is carried out according to clause 5.9 of this Agreement. It is the Participant's responsibility to regularly visit the official website of the Game in order to familiarize himself with the official documents and news.

5.9. The participant has the right to unilaterally terminate this Agreement without preserving the gaming account. In this case, all expenses associated with participation in the game are not reimbursed or returned to the participant. Gaming inventory (RUB), located in the participant's gaming account, are subject to return in accordance with clause 4.2.1.6 of this Agreement.

5.10. The Organizer has the right to unilaterally terminate this Agreement, as well as to take other actions limiting opportunities in the Game, with respect to the participant or a group of participants who are accomplices in identified violations of the terms of this Agreement. In this case, all gaming attributes, gaming inventory (RUB) located in the account and on the gaming account of the participant or group of participants, as well as all expenses, are not subject to return or compensation.

5.11. The Organizer and Participant are released from liability in case of force majeure circumstances, including, but not limited to: natural disasters, wars, fire, floods, explosions, terrorism, riots, civil unrest, acts of government or regulatory authorities, hacker attacks, absences, malfunctioning or failures of power supply, Internet service providers, communication networks, or other systems, networks, and services. The party affected by such circumstances must notify the other party of such circumstances in a reasonable time and in an accessible manner.

Confidentiality.

6.1. The confidentiality condition applies to information that the Organizer may obtain about the Participant during his stay on the Game site and which can be associated with this particular user. The Organizer automatically receives and records technical information from your browser into server logs: IP address, the requested page address, etc. The Organizer may record "cookies" on the user's computer and subsequently use them. The Organizer guarantees that the data provided by the participant when registering in the Game will be used by the Organizer only within the Game.

6.2. The Organizer has the right to transfer personal information about the Participant to third parties only if:

6.2.1. The participant expressed a desire to disclose this information;

6.2.2. Without this, the Participant cannot use the desired product or service, in particular - information about names (nicknames), game attributes - may be available to other participants;

6.2.3. This is required by international legislation and/or government authorities with compliance with legal procedures;

Other Provisions.

7.1. The invalidity of part or clause (subclause) of this agreement does not invalidate all other parts and clauses (subclauses).

7.2. The term of this Agreement is set for the entire period of the gaming platform's operation, i.e., for an indefinite period, and does not imply an end date for this agreement.

7.3. By registering and being on the gaming platform, the participant acknowledges that they have read, understood, and fully accept the terms of this Agreement, as well as the game rules and other official documents.

7.4. To receive the site's service, the Participant fully accepts all the terms of this Agreement. If you disagree with any of the terms of the Agreement, you are advised to refrain from using the site's services.
To prevent misleading the Participant (deception), the Organizer warns before the Participant's acceptance to use the site's services that the services offered to the Participant in the form of the game are based on the risk arising between several participants of the game according to the rules established by the organizer of this game.
The Participant's funds, necessary for facilitating the game (purchasing game resources, improving conditions for winning, etc.), accepted under the terms of the Agreement, are directed to the general gaming fund of the Participants (players), from which, among other things, winnings are formed. Accordingly, the organizer warns you that the game is partially based on the principles of a financial pyramid, and at any moment, you may lose all your funds without any claims against the site's organizer.
Moreover, by accepting the Agreement, the Participant confirms their consent to the use of the gaming fund by the Organizer for organizing and servicing the game among the Participants.
The final outcome of the gaming risk is winning. At the same time, the Organizer undertakes to minimize the negative consequence of the Participant's risk in the game, with the aim of attracting individuals to the site.
Simultaneously, the service presented in the form of the game is aimed at satisfying the needs of the Participant, which they independently determine and evaluate by their consent to participate.
The current game conditions and other site information do not aim to induce emotions in the Participant associated with the anticipation of success (excitement).

7.5. The Agreement comes into effect from the moment of the participant's registration in the project.
